The Internal Revenue Service (IRS) recently issued a Private Letter Ruling approving a tax-exempt hospital's participation in a dialysis facility joint venture with local nephrologists as furthering the hospital's exempt purposes (Priv. Ltr. Rul. 96-45018, November 8, 1996). While the ruling applies only to the parties who requested it, the release of a favorable Private Letter Ruling specifically addressing dialysis facility joint ventures is encouraging, as numerous hospitals seek alternative vehicles to structure their outpatient dialysis programs.
