The Court overturned the ruling of a single High Court Judge 1986) and held that the government of Punjab could discriminate in admissions to medical school with respect to sex when coupled with other admission considerations. It rejected the argument that such discrimination was prohibited by Article 25(2) of the Pakistan Constitution, which protects all citizens from discrimination on the ground of sex. It found that Article 25(2) was a general provision, which must give way before the special provision of Article 22(3)(b) of the Constitution, which prohibits restrictions on admission to educational institutions with respect only to race, religion, caste, or place of birth. Before this appeal was decided, the Government of Punjab voluntarily increased the number of seats for girl students by one hundred fifty-seven.
