Under the provisions of this Decree, which has been made in pursuance of the Law on Hospital Facilities of 25 March 1971 (Stb. 268) as amended, a new item 5 (laboratories in which human embryos are produced and stored) is added to Part E of Section 1 of the Decree of 1 August 1979 (Stb. 465) specifying institutions under the Law. A new item 11 (extracorporeal production of human embryos as part of in vitro fertilization treatment) is likewise added to Part A of Section 1 of the Decree of 24 November 1983 (Stb. 742) on special functions under the Law on hospital facilities, rendering such procedures subject to licensing by the Minister of Welfare, Public Health, and Culture. The Explanatory Note appended to the Decree states that these amendments have been made in order to establish in vitro fertilization as a special facility as referred to in subsection 1 of Section 18 of the Law; as a consequence, the extracorporeal production of human embryos is only permitted if a license has been issued by the Minister of Welfare, Public Health, and Culture of the Netherlands.
