Consumer Protection Act 1986 was finally made applicable to the medical services. Accordingly, any breach in the line of medical treatment make the treating physician to pay the damages caused to the patient. At times, the negligence will be so grave that a criminal case may be booked against the erring doctor. Doctors today, not only has to be well versed with the medical knowledge, but they also has to have a sound legal knowledge. The article revolves around the various aspects of medical negligence quoting the Supreme Court judgment and concluded with the precautions that one may take to avoid medical negligence.
