According to the restrictive juridical guidelines only severe mental disturbances can lead to a repeal of legal capacity. For the forensic-psychiatric expert the analysis of the psychopathological features is the decisive point, not a certain diagnosis. This proceeding is demonstrated by examples. Criteria are provided which may be helpful for the assessment.
